• If a background check is denied, the firearm cannot be transferred. You are responsible for return shipping to the seller and any applicable restocking fees. Fees we incurred (transfer, background check, shipping) are non‑refundable.
• If a background check is delayed, we will hold the firearm until an approve or proceed response, or until the applicable proceed date, consistent with law and our internal policy.
• If you cancel after the item has shipped to us, you are responsible for all shipping and any seller restocking fees.
7) Ordering, Fulfillment, Shipping, and Risk of Loss

• Title and risk of loss pass to you upon delivery to the carrier for shipments to your designated FFL. Inspect at pickup; discrepancies must be reported before transfer.
7.4 Ammunition and hazardous materials
• Ammunition ships ground service to eligible locations, adult signature required. Hazardous materials fees may apply. We do not ship ammunition to P.O. boxes or restricted addresses.

• Unused gift cards may be returned for a refund of the purchase price with a valid receipt and government photo ID.

• Manufacturer warranties: For new items, warranty terms are provided by the manufacturer. Contact the manufacturer for warranty claims. We can assist with information or shipment at your request.
• Gunsmithing services: Work orders describe the requested work. Test firing may be performed when needed. We warrant our labor for thirty (30) days from pickup. Wear, misuse, or third‑party modifications void this warranty.
• Optic mounting and zeroing: Mounting includes torque to spec and bore sight where applicable. Zeroing is not guaranteed without a live‑fire service package.
12) Privacy, Security, and Surveillance
• Checkout security: Our website uses industry‑standard Transport Layer Security (TLS) to encrypt data during checkout.
• ID and recordkeeping: We may scan or record identification as allowed by law for age verification, firearm transfers, and fraud prevention.
• Cameras: Our premises use video surveillance for safety and loss prevention.
13) Compliance and Export Controls
• We comply with federal, state, and local laws. Export of firearms, parts, optics, and certain accessories may be restricted by U.S. law. We do not export and do not ship to freight forwarders for export.
• Orders that appear to facilitate unlawful export or prohibited end‑use will be cancelled.
14) Pricing, Errors, and Omissions
• We strive for accuracy but do not guarantee that titles, descriptions, pictures, or prices are error‑free.
• We may cancel orders with errors in description or price and will not charge your card or will promptly refund amounts paid.
15) Safety and In‑Store Firearm Handling
• For gunsmithing or inspection, all firearms must be unloaded and cased. Notify a team member before unholstering.
• We may refuse service to anyone handling firearms in an unsafe manner.

• Governing law: The laws of the State of Texas apply without regard to conflict-of-laws rules.
• Venue: For any court proceeding permitted under this Section, venue is Harris County, Texas.

• Mutual arbitration agreement: Except for small-claims court actions, the parties agree to resolve any dispute, claim, or controversy arising out of or relating to a purchase, service, event, or these policies by binding arbitration before the American Arbitration Association under its applicable rules. The arbitrator may award individual relief permitted by law.
– Location and law: The seat and hearings will be in Harris County, Texas, and Texas law will apply.
– No class or representative actions: Claims must be brought in an individual capacity, not as a class member, private attorney general, or representative. The arbitrator may not consolidate claims without all parties’ consent.
– Small-claims option: Either party may bring eligible claims in small-claims court in Harris County, Texas, instead of arbitration.
– Opt-out: You can opt out of this arbitration agreement within 30 days of your first purchase after the effective date by emailing Randy@cobbarms.com with your name, contact information, and a statement that you opt out of arbitration. Opting out does not affect other provisions of these policies.
